Armed conflict in the East of Ukraine: the damage caused to the housing of the civilian population

The report “Armed conflict in the East of Ukraine: the damage caused to the housing of the civilian population” analyzes the scale of destruction of houses as a result of hostilities in the Donetsk and Luhansk oblasts, possible violations of international humanitarian law that could lead to a damage or destruction of homes of civilians, the impact of mass shelling on the population of the region, especially the protection of property rights of civilians during the armed conflict. Recommendations are provided to improve the situation.

The publication is prepared by Donbas SOS NGO within the initiative “Overcoming impunity for massive human rights violations and other international crimes committed in an armed conflict” and is being implemented within UNDP Ukraine’s “Civil Society for Enhanced Democracy and Human Rights in Ukraine” project with financial support from the Ministry of Foreign Affairs of Denmark and the “Human Rights and Justice” programme of the International Renaissance Foundation (IRF).

This overview looks at 5 cases of regional representation of a human rights defense system – those in Canada, Colombia, Croatia, India, and Spain. The publication highlights peculiarities of mandate distribution and coordination between the national and regional entities both under “centralized” and “network coverage” models. Suggested summary findings may inform further development of the Ukrainian “Ombudsperson +” model in its drive for wider regional presence for more accessibility of human rights defense mechanisms in the country.

Report – The loss of civilian population, the destruction of housing and infrastructure as a result of the armed conflict in eastern Ukraine

Jointly with NGO “Myrnyi Bereh”, Kharkiv Human Rights Protection Group conducted in-depth research, supported by UNDP, on the human rights violations during the conflict in eastern Ukraine in 2014-2018 to address the issues to the International Criminal Court.

According to the KHPG monitoring the losses are estimated approximately as 3500 deceased and 7000 wounded civilians.

Approximately 40 thousand residential buildings and 10 thousand of infrastructure objects were damaged, including more than 26.2 thousand residential buildings and 7.4 thousand infrastructure objects in Donetsk Oblast. 130 hospitals stopped functioning. Over 1600 victims of the mines’ explosions were registered.

Cases of the sexual and gender-based violence, torture of captives, rapes and other war crimes have also been documented in the independent report.

Authors conclude that there is no unified database for conflict-affected civilians. Different state authorities rely on completely different data, accordingly, there is no state mechanisms to compensate for damages.

The results of the report are being summarized and recommendations are to be provided to the state authorities.

How does evaluation help to make the government more open and accountable?

Collaboration with the civil society and the stakeholders is a vital component of the state authorities’ performance. They include, in the first place, receiving feedback, monitoring public reaction to the current policies, ensuring transparency and openness of activities of the state institutions.

The first step toward improving the interaction of a governmental institution with wider public may be introducing evaluation of its activities in the respective sphere.

By joint effort of representatives of the Ukrainian civil society and the Government with UNDP support, a pilot methodology was developed and tested for evaluating efficiency of the interaction of an executive body (a ministry, agency, etc.) with wider public.

The assessment methodology is based on the understanding that the interaction with the wider public takes place at four levels: information, consultations, dialogue and partnership.

At each of these levels, the state authority initiates and leads a three-stage process: planning-action-outcomes.
